Privacy Policy

The protection of your personal data is a priority for Casa dos Aromas. Below, we describe who we are, the purposes for which we may use your data, how we process it, with whom we share it, how long we retain it, as well as how to contact us and exercise your rights. Who are we? Your data will be processed by the team managing Casa dos Aromas, a legal entity, Tax ID No. 510233732. Hereinafter, Casa dos Aromas is the data controller responsible for processing your personal data within the meaning of the General Data Protection Regulation (hereinafter referred to as the GDPR). Why do we process your information? Your personal data may be collected and processed by Casa dos Aromas for the following purposes:
a) To comply with legal obligations to which the accommodation is subject, namely communications to the Foreigners and Borders Service and billing.
b) For the purposes of executing the Temporary Tourist Accommodation Agreement or the Accommodation Management Agreement entered into with each accommodation provider, including payment transactions, check-in and check-out management, guest management, security deposit holds, provision of complementary services such as cleaning and transfers, management of contractual obligations, or for pre-contractual procedures.
c) For the purpose of contact via email, mobile communications, and digital platforms, within the scope of each accommodation’s marketing strategies, commercial and contractual information and communications, as well as for requests for information.
d) For the purpose of protecting property owned or held in custody by each accommodation, as well as for statistical analysis.

Failure to provide personal data for the purposes set forth in subparagraphs a) and b) will result in the accommodation provider’s failure to comply with the legal obligations imposed upon it and, consequently, the possibility of termination of the Temporary Tourist Accommodation Contract or the Accommodation Management Contract, entered into, without any right to compensation, as well as a substandard provision of services by each accommodation, for which it cannot be held liable.

What kind of personal data do we collect?
As part of its operations, Casa dos Aromas or the accommodation provider you contact will collect and process the personal data necessary to provide the contracted services, respond to requests for information, or carry out pre-contractual management, including identification, contact, banking, and payment card information.

Why do we process your information?
The processing of your personal data will be carried out based on the execution of the Temporary Tourist Accommodation Contract, the Accommodation Management Contract, and compliance with legal obligations imposed on each accommodation provider, specifically under legislation regarding Entry, Stay, and Departure of Foreigners in the National Territory, and tax legislation (Article 6(1)(b) and (c) of the GDPR). Additionally, the personal data collected for the purposes set forth in subparagraph c) of the previous point is based on the consent you have provided to each accommodation for the respective processing (Article 6(1)(a) of the GDPR). For the purposes set forth in subparagraph (d) of the preceding paragraph, each accommodation provider will process personal data based on its legitimate interest (Article 6(1)(f) of the GDPR).

How long do we retain your information?
Unless otherwise required by law, regulation, or court order, the personal data we collect will be retained only for the minimum period necessary for the purposes for which it was collected or further processed.

To whom may we disclose your personal data?
Casa dos Aromas or the accommodations may need to share some of your personal data with other recipients. These recipients include:
a) Organizations and/or companies affiliated with the accommodations, provided they adhere to an equivalent policy regarding the protection of personal data.
b) Public entities to which the accommodations are legally required to provide information, namely the Foreigners and Borders Service and the DGCI – Directorate-General for Taxes.
c) Subcontractors who provide certain services related to your personal data under a subcontract and for the sole purpose of providing technical assistance to Casa dos Aromas. These include, in particular, website hosting providers, email marketing service providers, cleaning service companies, law firms, accounting firms, and insurance companies.
d) The competent authorities to which Casa dos Aromas is legally obligated to disclose information in the course of legal proceedings or to detect technical and/or security issues, such as judicial bodies or competent supervisory authorities.

Is my data transferred to countries outside the European Union?
Your personal data, collected by Casa dos Aromas, will not be transferred to any entity located outside the European Union. In exceptional cases and under certain conditions, Casa dos Aromas may transfer your personal data to countries outside the European Union, in accordance with applicable law, specifically for the purposes of data hosting or storage, technical outsourcing of processing, backup and recovery of hosted data, and service development.  

Casa dos Aromas assures you that it will not transfer your personal data to countries that do not guarantee an adequate level of protection, in accordance with the provisions of the GDPR. What are my rights? At any time, in accordance with the provisions of the GDPR, you may request access to your personal data, as well as its rectification or erasure, restriction of processing, the right to object, and the right to data portability. If the requests submitted are manifestly unfounded or excessive, particularly due to their repetitive nature, Casa dos Aromas may require payment of a reasonable fee, taking into account the administrative costs of providing the information or communications, or of taking the requested measures, or refuse to comply with the request. With regard to personal data whose processing by Casa dos Aromas is based on consent, you have the right to withdraw your consent, without the exercise of such right compromising the lawfulness of the processing carried out based on the consent previously given, nor the subsequent processing of such data based on another legal basis, such as the performance of a contract or a legal obligation to which Casa dos Aromas is subject. You also have the right to file a complaint with the National Data Protection Commission. Security and Confidentiality We are committed to keeping your data secure, and we implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk of storing your personal data. However, the transmission of administrative costs associated with providing the information or communications, or with taking the requested actions, or to refuse to comply with the request. With regard to personal data whose processing by Casa dos Aromas is based on consent, you have the right to withdraw your consent, without the exercise of such right compromising the lawfulness of the processing carried out based on the consent previously given, nor the subsequent processing of such data based on another legal basis, such as the performance of the contract or the legal obligation to which Casa dos Aromas is subject. You also have the right to file a complaint with the National Data Protection Commission. Security and Confidentiality We are committed to keeping your data secure, and we implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk involved in storing your personal data. However, transmitting information over the Internet is not completely secure, and we cannot absolutely guarantee the security of information transmitted through our website. We also respect the confidentiality of your information. As such, we do not sell, distribute, or otherwise make your information commercially available to third parties.
